1. Acceptance of Terms

By accessing or using this forestry mapping platform (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Service Description

The Service provides a mapping platform that includes:

  • High-resolution color and multispectral imagery
  • LiDAR data visualization and analysis
  • GeoTIFF export capabilities
  • Polygon-based standing timber volume calculations
  • Growth trajectory estimates based on user-provided data and variables

3. IMPORTANT NOTICE FOR LANDOWNERS

This Platform is a Learning and Planning Tool Only

Our service is designed to help landowners learn about and plan for their forest property. Think of it like a “forest property calculator” – it gives you estimates to help you understand your land better, but it’s NOT a professional analysis.

What Our Platform Does:

  • Provides estimates about timber volume and potential value
  • Helps you explore different management scenarios
  • Shows satellite imagery and mapping data
  • Gives you a starting point for forest planning

What Our Platform Does NOT Do:

  • Replace professional forestry advice
  • Provide accurate appraisals for buying/selling property
  • Give you definitive answers about what to do with your land
  • Substitute for on-the-ground forest evaluation

Before Making Important Decisions:

4. CRITICAL DISCLAIMERS AND LIMITATIONS

THE SERVICE IS AN APPROXIMATION TOOL ONLY. All calculations, estimates, projections, and analyses provided by the platform are approximations based on algorithms, user-provided data, and various assumptions. These are NOT precise measurements or professional forestry assessments.

4.2 No Professional Advice

THIS PLATFORM IS NOT A SUBSTITUTE FOR PROFESSIONAL FOREST MANAGEMENT SERVICES. The Service does not provide professional forestry advice, consulting, or recommendations. Users must consult with qualified forestry professionals, certified forest managers, or other appropriate experts for professional advice.

4.3 No Financial Decision-Making

NO FINANCIAL DECISIONS SHOULD BE MADE SOLELY BASED ON THIS PLATFORM. The estimates, projections, and calculations provided are not suitable for financial planning, investment decisions, insurance valuations, tax assessments, or any other financial purposes without independent professional verification.

4.4 Data Accuracy Disclaimer

Silvicultural LLC makes no warranties regarding the accuracy, completeness, or reliability of:

  • Satellite imagery or aerial photography
  • LiDAR data
  • Growth models or algorithms
  • Volume calculations
  • Any third-party data sources

4.5 Property Evaluation and Real Estate Disclaimers

NOT FOR REAL ESTATE DUE DILIGENCE: This Service is not intended for, and should not be used as, a substitute for professional property inspections, real estate appraisals, or due diligence investigations. Property buyers should:

  • Conduct professional timber cruises and forest evaluations
  • Obtain independent real estate appraisals
  • Consult licensed real estate professionals
  • Perform comprehensive due diligence with qualified experts

NO PROPERTY VALUATION: The Service does not provide property valuations, real estate advice, or investment recommendations. All calculations are preliminary estimates only and should not influence purchase decisions without professional verification.

BUYER RESPONSIBILITY: Users evaluating properties for purchase are solely responsible for all due diligence activities and should not rely on this platform for purchase decisions.

5. User Responsibilities

5.1 Data Quality

Users are solely responsible for:

  • The accuracy and quality of all data they input into the system
  • Verifying the appropriateness of variables and parameters they provide
  • Understanding the limitations of their input data
  • Ground-truthing any estimates or projections

5.2 Appropriate Use

Users agree to:

6. Limitation of Liability

6.1 No Liability for Estimates

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SILVICULTURAL LLC DISCLAIMS ALL LIABILITY FOR:

  • Inaccurate estimates, projections, or calculations
  • Decisions made based on Service outputs
  • Financial losses resulting from use of the Service
  • Errors in data processing or algorithms
  • Failures of growth trajectory models

6.2 Maximum Liability Cap

Silvicultural LLC’s total liability to you for all claims arising from your use of the Service shall not exceed $2,500 per incident, provided that our total aggregate liability shall not exceed $5,000 regardless of the number of incidents.

7. Membership Terms

7.1 Membership Types

We offer two membership types:

  • Annual Membership: Valid for one year from purchase date
  • Lifetime Membership: Valid for the lifetime of the Service

7.2 Refund Policy

60-Day Money-Back Guarantee: All memberships may be refunded for any reason within sixty (60) days of purchase. No product returns are necessary. 7.3 Lifetime Membership Limitations

Lifetime memberships are subject to the following conditions:

  • Service Continuation: We reserve the right to discontinue the Service at any time for any reason, including but not limited to business closure, technical limitations, or economic factors
  • Feature Modifications: We may add, remove, or alter features, functionality, or capabilities at our sole discretion
  • Refunds After 60 Days: Lifetime memberships are non-refundable after the 60-day refund period, even if the Service is discontinued or substantially modified
  • Migration Rights: If we discontinue the Service, we may offer migration to alternative services, but are not obligated to do so

7.4 Service Availability

Silvicultural LLC does not guarantee:

  • Uninterrupted Service availability
  • Maintenance of current feature sets
  • Compatibility with future technologies
  • Continued access to third-party data sources

8. Intellectual Property

8.1 Silvicultural LLC’s Rights

The Service, including all software, algorithms, imagery processing methods, and user interfaces, is the proprietary property of Silvicultural LLC or its licensors.

8.2 User Data

You retain rights to data you upload, but grant Silvicultural LLC a license to process and analyze such data to provide the Service.

8.3 Export Rights

You may export your own data and analysis results for personal or business use, subject to any third-party licensing restrictions.

9. Indemnification

You agree to indemnify and hold Silvicultural LLC harmless from any claims, losses, damages, or expenses arising from:

  • Your use of the Service
  • Decisions made based on Service outputs
  • Your violation of these Terms
  • Your data inputs or their inaccuracy

10. Privacy and Data

10.1 Data Processing

Silvicultural LLC processes user data solely to provide the Service. We do not sell user data to third parties.

10.2 Data Retention

Silvicultural LLC may retain user data for reasonable periods to provide the Service and comply with legal obligations.

10.3 Data Deletion

Upon account termination, Silvicultural LLC will delete user data within a reasonable timeframe, except as required by law.

11. Service Modifications and Termination

11.1 Silvicultural LLC’s Rights

Silvicultural LLC reserves the right to:

  • Modify, suspend, or discontinue the Service at any time
  • Update these Terms with reasonable notice
  • Terminate accounts for violations of these Terms
  • Refuse service to any user

11.2 Force Majeure

Silvicultural LLC is not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, or third-party service failures.

12. Export Control and Compliance

Users are responsible for complying with all applicable export control laws and regulations when using geographic data and analysis tools.

13. Governing Law and Disputes

These Terms are governed by Maine state law. Any disputes shall be resolved through binding arbitration in Aroostook County, Maine.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
