1. Introduction
1.1 This Terms of Service (“Agreement”) governs your access to and use of SilviCultural (the “Platform”), a subscription-based online community platform. By accessing or using the Platform, you agree to be bound by this Agreement.
2. Account Creation and Subscription
2.1 To access certain features of the Platform, you may be required to create an account. You agree to provide accurate and complete information during the registration process.
2.2 SilviCultural is a subscription-based service. You agree to pay the applicable subscription fee as described on the Platform.
2.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. User Conduct
3.1 You agree to use the Platform in a manner consistent with applicable laws and regulations.
3.2 You agree not to: * Post or transmit any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content. * Impersonate any person or entity or falsely represent your affiliation with any person or entity. * Interfere with or disrupt the operation of the Platform or any servers or networks connected to the Platform. * Violate the intellectual property rights of others.
4. Intellectual Property
4.1 The Platform and its content, including but not limited to text, images, software, and code, are owned by or licensed to SilviCultural and are protected by copyright, trademark, and other intellectual property laws. 4.2 You retain ownership of any content you submit to the Platform. However, by submitting content, you grant SilviCultural a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and display such content.
5. Termination
5.1 SilviCultural may terminate your account and access to the Platform at any time, without cause or notice, if you violate this Agreement.
5.2 You may terminate your subscription at any time by following the instructions on the Platform.
6. Disclaimer of Warranties
6.1 THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
7. Limitation of Liability
7.1 IN NO EVENT SHALL SILVICULTURAL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE PLATFORM.
8. Indemnification
8.1 You agree to indemnify and hold harmless SilviCultural and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or in connection with your use of the Platform or your violation of this Agreement.
9. Changes to Terms of Service
9.1 SilviCultural reserves the right to modify this Agreement at any time. Changes will be effective upon posting on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the modified Agreement.
10. Governing Law
10.1 This Agreement shall be governed by and construed in accordance with the laws of the state of Maine.
